Bundy’s Pursue Release of All Defendants

The Bundy family and supporters are grappling with what to do about the tyrannical outcome of the Bundy trial co-defendants that are still incarcerated. Ammon Bundy is asking the jurors that served on the Grand Jury or the first and second trials in Nevada to review information that was withheld from them.  Ammon Bundy would like to determine if those on the Grand Jury would still have indicted; and if the trial jurors would still have convicted the defendants, if they had seen the evidence that was withheld due to the Brady violations of the prosecutorial team.  This is the same evidence that freed the last two groups of defendants.

Another approach to freeing these men is a new petition asking for a presidential pardon for all the defendants who stood with the Bundy’s at Bunkerville.  It is on a website titled “We the People, Your Voice in the White House”.  This petition includes Eric Parker, Scott Drexler, Jerry Delemus and Pete Santilli, who all took plea agreements; plus Todd Engel and Greg Burelson, who were convicted at the first trial.

A review of the court records for the USA v Cliven Bundy trials reveal how biased the court proceedings really were.  Listed below are types of evidence and arguments that the defendants and their attorneys were not allowed to make.  This bulleted list is from a motion Prosecutor Steven Myhre filed for the third trial.  Very similar motions were filed for each trial and Judge Navarro granted each one. These restrictions are placed solely on the defense evidence and arguments and led the way for many of the prosecutions Brady violations:

  • Self- defense, defense of others, or defense of property, justification, necessity arguments which have no foundation in the law;
  • Third-party/lay person testimony about the level of force displayed or used by law enforcement officers…
  • Opinions/public statements of Governor Brian Sandoval of April 8, 2014 and/or opinions registered by other political office holders…
  • Allegations of workplace misconduct by SAC… (Special Agent in Charge, Daniel Love)
  • Allegations that officers connected with the impoundment acted unethically…or they improperly shredded documents.
  • References to supposed mistreatment of cattle…
  • Legal arguments, beliefs, explanations or opinions that the federal government does not own the land or have legal authority…
  • Legal arguments, beliefs, explanations, or opinions regarding infringement on First and Second Amendment rights, including any effort to confuse the jury that there is some form of “journalist” or “protest” immunity for the crimes charged;
  • References to punishment the defendants may face if convicted of the offenses;
  • References to the Oregon trial of United States v. Ammon Bundy, Ryan Payne, and Ryan Bundy or the results in that trial;
  • References to the outcomes in the previous two trials in this case and
  • Legal arguments, explanations, or opinions advancing defendants’ views of the U.S. Constitution…

The defendants in the first two trials only had a week to present their case and most of that time was spent with the judge disqualifying witnesses and evidence without the jury being present in the courtroom. During the second trial, the restrictions on what could be said left the defendant’s attorneys with no intelligent closing arguments to make. All four attorneys, with their clients’ consent, declined making a closing argument.  The jury may have seen the act of declining their closing argument as a red flag, letting the jury know that there was something very wrong with how the case was being presented. There were no convictions at the conclusion of that second trial!

The worst example of the governments persecution of these men fell to Greg Burleson during the first trial.  He was sentenced to 68 years and three months in federal prison for his minor role in the April 12, 2014 protest near the Cliven Bundy Ranch.  At his age of 53, that is a life sentence.  He was among the least culpable group of defendants.

Greg Burleson provided basic security on April 12, 2014 for the crowd of protesters in the Topqua Wash. The prosecution team used a photo of Burleson holding a long gun at the protest, yet no witnesses nor photos established that he ever raised or aimed his weapon in any direction.  Burleson spent a lesser amount of time at the protest than most of his co-defendants. He did make the mistakes of later posting numerous extreme comments on Facebook and he allowed Longbow Productions to interview him.

A motion to exclude the Longbow Productions evidence from the Cliven Bundy case, filed in February 2017 states, “the FBI created a fake film production company designed to trick defendants into making boastful, false, and potentially incriminating statements that could be used against Defendants.”  Daniel Hill, Ammon Bundy’s lawyer, stated that “they impersonated journalists so they could interrogate people the FBI fully intended on charging with serious crimes, without any lawyers present.

Longbow traveled to at least five states to interview at least 20 different people.  They plied Greg Burleson with alcohol and baited him into making several rash statements  that included bragging that he went to the Bundy Ranch “to kill federal agents”.  The motion to exclude the Longbow documentary evidence was denied yet the fact that Greg Burelson was given two alcoholic drinks by the FBI just before his interview was withheld from the jury.

An excerpt from an interview with Greg Burleson, produced by undercover FBI agents posing as filmmakers, obtained by The Intercept:

During the trial, the prosecution called FBI Agent Michael Caputo and FBI Agent Adam Nixon to the stand.  Then the court instructed the jury that this testimony would be used only in reference to defendant Burleson.  The only defense attorney that was allowed to cross examine the two agents was Burleson’s public defender, Terrence Jackson.  Jackson questioned the agents until they admitted to Burleson’s status as an FBI informant.

Attorney Terrence Jacksons aligning his client with the FBI in the Cliven Bundy case of the Bunkerville protest seemed to be counterproductive at best.  Jackson made no attempt to have Greg Burleson explain what his involvement with the FBI had been.  After the trial Greg Burleson was able to have a friend post his explanation, but it was too late and the jury did not have that information when they found him guilty.

Burleson’s public statement explained his involvement with the ‘US Border Guard’ organization founded by a man named J. T. Ready.  They were a militia group that “located and documented cartel foot paths and vehicle paths into the United States, where cartel drug mules and human smugglers would wait to be picked up by their contacts and taken into the country”.  Greg Burleson described how they  “…would give all this information to Border Patrol Tactical Division or Maricopa County Sheriffs Department and Pinal County Sheriffs Department.  So we were cooperating with law enforcement and they actually were kind of grateful for us especially when we were able to shadow cartel people moving through the desert at night.”

“…In 2012 this is how I got involved with the FBI.  J.T. Ready committed a quadruple murder suicide. You can look this up on line. He killed his girlfriend, her daughter, her granddaughter, the father of the child and then killed himself. The FBI contacted me for whatever reason, I guess because I was associated with him in the past. They wanted to know how he got money for supplies and equipment and stuff you know and they called me in to ask me what I knew about J.T. Ready.”

”I ‘never’ gave them any information on any specific individual or any group that they were asking about”…”I simply told them information about new cartel, new paths, layover points, lookout points and you know stuff that we were finding out in the desert. I was giving them information I wanted to give them and not what they were looking for. ‘They’ weren’t really interested in the information about the cartels and stuff.”

“…THIS IS CRITICAL NOW…they kicked me to the curb!! In other words they terminated our agreement and when they did that, the person that did that was Adam Nixon”… “But they ‘did’ terminate my services in 2013! I was NOT a FBI agent or informant or anything down in the wash in 2014. 2014 when I went there was strictly to find out if what I was seeing on the internet was true and to give aid, comfort and support to the Bundys and the protestors and supporters.”

Burleson went on to explain the contact he made with the FBI on January 5, 2015;  “I called Mark Caputo to see if he could give me legal advise or possibly turn me towards a good 2nd Amendment lawyer.  Also I was asking him why I was on the terrorist watch list?”

“When they brought Caputo on the stand in the trial, his sole purpose was nothing more than character assassination and to drive a wedge between me and the so called Patriot community.”

Greg Burleson had been separated from his co-defendants during his incarceration in Nevada due to diabetes and related medical problems. He complained about not having his medications and a general lack of medical care. During pre-trial detention Greg Burelson went totally blind and became confined to a wheelchair.  In the courtroom he was flanked by a nurse and attendant. The jury saw him only after his appearance had deteriorated to that of a man that could be perceived as scary; his hair was shaggy and disheveled and occasionally he had seizures.

A jury convicted Greg Burleson in April of 2017 on the eight counts including  obstruction of justice, interstate travel in aid of extortion, assaulting federal officers, threatening federal officers, and using a firearm in crimes of violence.

At the July 26, 2017 sentencing hearing Greg Burleson told Judge Navarro;  “Yes, I said a lot of crazy things. I’m ashamed of them actually,”… “Looking back at them, it’s like, wow, obviously I shouldn’t drink.”  Burleson also told Judge Navarro, …“Yes, I was down in the wash. I went down there with the intention to see what was going on,” …”I did not go down there with the intention of assaulting or killing anyone.”

Navarro gave Burleson a 10-point reduction in his sentencing score based on the combination of Burleson’s medical issues, alcoholism, and past assistance to law enforcement.  Burleson’s 68 year sentence was lower than the 87 that prosecutors had recommended.  Burleson also was ordered to pay $1.5 million in restitution to the government, to reimburse taxpayers for the labor and contractor costs of the failed cattle operation.

Greg Burleson is sentenced to spend the rest of his life in prison because; (1) due to his medical condition, he looked scary to the jury, (2) he was intoxicated when he gave an interview to the FBI who were pretending to be journalists and (3) he made some outrageous posts on Facebook after the protest.

Burleson’s own Public Defender, Terrance Jackson, might have turned many jurors against him by not pursuing whether or not Burleson was an active FBI informant at the protest.  The jurors in the prior Ammon Bundy  trials in Oregon found the FBI’s use of informants to be at least distasteful, if not unethical.  Jurors that became sympathetic to the protestors may have been influenced to convict.  Greg Burleson is now totally blind and in poor health, so poses no threat to society.

    The libeler here on this web page, perpetrating the crime of libel, ought to be prosecuted to the full extent of the real law. The problem is that the criminals have taken-over the government, so there is no real law here in America.

    The libeler here, on this web page, will not face a jury trial, according to the common law, no more than the murderers of Lavoy Finicum will face a common law trial by the country, for if they did, then the truth, at least according to the jury that represents the whole country, would be on the official record for all to know.

  2. Mr. Kelley…facts are certainly more powerful than ad hominin. Having viewed that video twice now, the premise appears to be that the cops don’t have the right to set a bear trap. Finicum arrogantly drove right into that bear trap. Like I said previously, best wishes to the Finicum widow in her wrongful death suit. She not only has to establish that the cops don’t have a right to set a bear trap on this occasion, but also that her husband wasn’t suicidal despite all the evidence. Good luck with that.

    I find it the height of hypocrisy for doofus Ammon to get on social media and label the OSP Officer who shot Finicum to be a “murderer”. Especially when there are people here in Vegas calling Ammon a “cop killer”. The fact that he is still breathing strongly refutes the “murder” narrative, yet Ammon is so self-unaware that he feeds into the craziness with his continued stupidity.

    Mr. White, in a previous thread I agreed that calling the Bundys cop killers is…as you put it…like fishing with hand grenades. Unfortunately for the Bundys, Las Vegas Democrats are exploiting that Miller connection to the Bundy standoff and are pounding Republican Cresent Hardy with it over his perceived ties to the Bundys. Almost all of my Metro officer friends (and I have a bunch) have a seething contempt for the Bundys as a result of the standoff AND the Miller caper. If Ammon had half a brain, he might consider toning down his over-the-top rhetoric so that more sensible minds might actually bring this to a reasonable compromise.

Unlike you dupes from out-of-state, I have had a front-row seat to this Bundy clown show for the past 30 years and happen to know what I am talking about. When you live in the neighborhood, it is easy to see the difference between Bundy bellyaching bull and what is real.

    Yeah…I wish I was getting paid for trying to talk sense to you imbeciles. Your minds are made up and can’t be confused with facts. One can only hope that their fellowman could be reasoned with.

    One other thing that you Bundy sycophants should keep in mind. If you think it fair or just to repeat the mantra that Finicum was “murdered”, then it likewise is fair or just for Las Vegas Democrats to campaign against Republican Cresent Hardy by declaring the Bundys as cop killers, since the Millers had Bundy idiocy on their minds when they gunned down Las Vegas Metro Cops Egor Soldo and Allen Beck.

      Anyone can take up the cause of absolute, arbitrary, government, pro-bono or on the dole.

  5. Fake government agents include people who are paid to troll all forms of communication media. It is fake government because the real government would hold these types of criminals to account for their crimes, rather than pay them to perpetrate these types of crimes.

    If there was no fake government, then there would have never been an effort to steal any land that was improved by any individual member of lawful, moral, society, such as any Rancher, or Farmer, or Miner.

    Since government is fake, then the ability to hold criminals to account is gone, and in place of that ability to hold criminals to an accurate accounting, which include holding trolls who are paid to publish false information, is a method by which productive people are forced, by fraud, extortion, and aggressive violence, to pay for their own tormentors.

  6. Mr. White, you are the one who implied that Southern Nevadans were coveting Bundy’s cows, presuming we were unaware that “Bundy Beef” was actually inedible.

    I suppose, however, that Bundy’s cows gets to the nitty-gritty of this whole clown show. That is, should Bundy continue in his quixotic quest to graze the VERY dry Mojave Desert? It obviously is a political and scientific question, and obviously reasonable minds can differ.

    Bundy was offered compensation for his grazing rights by the Clark County Tortoise mitigation fund, paid for by Southern Nevada builders through building permits. Most ranchers in the area jumped at the chance to cash in their very marginal operations; Bundy resisted, as was his right. Clark County, having bought all the grazing permits surrounding Bundy’s allotment, had all cattle taken off their newly acquired allotments. Bundy dishonestly let his cattle encroach on the now Clark County’s legitimate range–a clear violation of law. That, frankly, is theft and the stuff of which real “range wars” are made. The BLM ordered Bundy to limit his cattle to his allotment and to only graze what they considered that his allotment would sustain. Bundy rejected that order. Then Bundy whines that the BLM is attempting to run him out of business–which for his cattle operation is probably true–but these are public lands, after all, and the powers that be at BLM have determined that the experiment in grazing the VERY dry Mojave Desert has been an abject failure. Exhibit “A” is the scurvy, malnourished Bundy cattle. So Bundy “fires” the BLM, refuses to pay his legitimate grazing fees, and we are off to the races.

    So you are sort of correct in a perverse way to say that they are wrong because their cattle’s “taste is off”.

    • If I had a heart I would actually feel sorry for you and people like you; it is a special kind of fantastical thinking to drive people who create food out of business and then expect your food supplies to be secure.

      At least in “Only by Blood and Suffering: Regaining Lost Freedom” by Lavoy Finnicum there were cows to be “appropriated”…and that is just a fictional novel. Your reality is you would drive them completely out of the cattle business entirely. Yes, you must be a very special person.

Funny thing about Mr. Finicum being “murdered”: one has to ignore all his rants on YouTube and social media where he clearly became progressively militant and resolved to die in his Oregon endeavors. And his arrogance in speeding away from a legitimate traffic stop. And his “just shoot me” chants clearly defining his state-of-mind as he is driving down the road–gathered from cell phones of Ryan Bundy and Shauna Cox. He ignored officer’s commands, acted like a crazy person, and reaped the consequences. So my best wishes to Mr. Finicum’s widow in her wrongful death suit. Most normals would easily conclude that Mr. Finicum clearly committed “suicide by cop”. If it were “murder”, why kill him only while doofus Bundy Boys Ammon and Ryan survived? How do the ring-leaders walk while a self-important “spokesman” dies??? Could it be that they actually complied with officer’s commands, unlike Mr. Finicum??

    Careful who you accuse of “murder”; by the same measure you judge (or accuse…), you will be judged. After all, you folks on this site are “God Fearing, Freedom Loving Patriots”.

    Mr. White: it is obvious you haven’t eaten “Bundy Beef”. Everyone I know who have relate that it is hardly edible. What can one expect when these scurvy/malnourished cows are left to fend for themselves in the Mojave Desert…driest in North America? And delusional Bundy sees it as his personal cow pasture. (For you Idaho folk…Bundy actually is much more a melon farmer than he is a John Wayne Cattle Baron…) Yeah…move Bundy and his cows to Idaho…everyone wins; Nevada residents get rid of a toxic anarchist welfare queen who has a particularly annoying bellyache, and his cows could actually find something to eat.

  8. While posing as “Constitutional Scholars”, the Bundy’s don’t seem to grasp the law of unintended consequences. Had anyone been shot at the April, 2014 standoff, the Bundy doofuses would have been charged with first degree murder under the felony murder rule. That they were sufficiently reckless with the lives of those who came to support them is no surprise. What was particularly egregious was their use of “human shields” to make their gunman more difficult to isolate–a cowardly and dastardly act in itself. Dan Love appears to have wanted a fight; Governor Brian Sandoval took that fight away by clearly declaring that “no cow is worth the life of a human.” Would that the Bundy’s had such scruples.

    The Bundy family got off because a lazy Federal Judge didn’t want to be bothered with actual work and therefore accepted some lame “Brady violation” accusations–easily refuted as pertaining to the charges. No surprise she would sustain what little work she did with the prior convictions of those who were duped into doing the Bundy’s dirty work. The Feds will want to keep these defendants in prison because they want to send a message that when “round two” comes, the Bundy crazies had better think twice. And “round two” will be coming sooner or later…but perhaps not during Trump’s tenure.

    I applaud the pardons for the Hammonds. They didn’t act as anarchists as did the Bundys. To think that Trump would pardon goons who pointed guns at law enforcement is the height of wishful thinking. Many Metro officers perhaps were favorably disposed of the Bundy’s situation prior to the standoff; you would be extremely hard-pressed to find anyone in local law enforcement who are favorably disposed now. Trump would never disrespect law enforcement by pardoning cavalier anarchists who have no problem pointing guns at cops and think they can get away with it.

    Fact is, should front-running Democrat Steve Sisolak be elected Nevada Governor, knowing him, first thing he does after taking the oath of office is to go after the Bundy’s with everything the State has at its disposal. It would be interesting to see how “states rights” and “state lands” Bundy would respond to Sisolak in this scenario.

    Since you folks in Idaho are so enamored with the Bundy’s, I would hope you would urge them to relocate to your state so we don’t have to put up with their drama-queen antics anymore. Then perhaps you’ll understand why the vast majority of Bundy’s support comes from out-of-state, rather than from his neighbors.

    • That sounds like a good idea and hopefully they take their cattle with them. You nutjobs won’t be able to vote yourselves the Bundy’s cattle if they are not around Las Vegas if the need should arise.

    • I suspect that had anyone been shot at the April, 2014 standoff, there would be another wrongful death suit filed against the government, just as there is currently for the murder of LaVoy Finicum.
