All Charges Dropped Against “Baby Cyrus” Mom and Family Members
On Tuesday, December 13, Marisa Anderson announced that all charges surrounding the Baby Cyrus Court Cases, including the Resisting and Obstructing Arrest charges leveled against Marissa (the baby’s mother) and Miranda (the baby’s aunt) have been dropped.
In a case that made national news, police from Meridian, displayed an excessive show of force in abducting “Baby Cyrus” in March of this year. Without clear evidence, Meridian police detective Jeff Fuller declared that Baby Cyrus was in “imminent danger.” Once the vehicle driven by the parents was pulled over, no on-site inquiries were made. No statuses were checked. With no reason to do so, police aggressively manhandled and handcuffed the baby’s father, and Sergeant Christopher McGilvery slammed him against the vehicle without cause.
Then, without bothering to check the identity of the woman in the front seat, McGilvery aggressively manhandled and handcuffed her. The woman was actually the child’s aunt (Miranda). When Miranda stated she was not the child’s mother, McGilvery then said she was under arrest for providing false information to a police officer. Miranda was double-cuffed and put in the back seat of a police car.
Meridian Police lied to the mother
Once McGilvery realized the mother was still in the car with the baby, he became like Dr. Jeckyll and Mr. Hyde. Opening the back door of the vehicle, McGilvery softened his voice tone and blatantly lied to the mother, telling her they needed to take the baby to the hospital in the ambulance and that the mother, Marissa, could go with if she wanted.
As the video shows, McGilvery blatantly lied to the mother on multiple occasions. Once he baited Marissa into the ambulance, Meridian Police Detective Steven Hansen told the mother that she needed to give up her son and that she would not be allowed to go to the hospital with him. The mother informed Hansen that she had been told that she would be able to accompany the baby to the hospital, but Hanson denied her that right, saying he didn’t know what was promised her before, but she would not be allowed to stay with the baby. Without any emotion or empathy, Hansen told the mother, “Give the baby to the EMT and you can go on your merry way.”
One woman who watched the video of the kidnapping said, “No mother on the face of the earth would willingly comply with such a flippant, cold, cruel, and heartless demand.”

No imminent danger
Documents produced later by St. Luke’s Hospital indicate that they knew the baby was not in imminent danger. Rather than keep the baby in the hospital for observation, Child Protective Services had planned to shuffle the child to a foster family the same night the baby was abducted.
The abduction caused dozens of people to protest at St. Luke’s hospital. During the ensuing days, protests also occurred outside Health and Welfare offices.
Some people working inside CPS realized that a grave injustice was occurring, and they secretly emailed evidence of what was really going on to the child’s grandfather. This helped get the truth out, because Judge Laurie Fortier issued a gag order on the parents, threatening them with arrest if they spoke publicly about the case.
No evidence of danger or neglect
In Idaho Statutes, Title 16 Chapter 16 states that for any child to be forcibly taken from his or her parents, clear evidence must exist showing that (a) the child is in imminent danger, and (b) the parents must be shown to be the cause of that danger, either by conduct or omission.
Once in front of the judge, neither prosecutor Kyle Bringhurst nor CPS representative Rozanne Printz could produce any clear evidence of danger or neglect.

All charges dismissed
Both the mother, Marissa, and the aunt, Miranda, were arrested and charged by Meridian Police with Obstruction of Justice and Resisting Arrest. Nine months after the illegal arrests and illegal abduction of Baby Cyrus by Meridian Police and Idaho’s Child Protective Services, the mother has announced that all charges have been dropped.
On her Facebook page, Marissa wrote:
After 9 long months, my criminal charges of “Resisting and Obstructing” have been dropped!
That means all 3 cases in my family stemming from the night Cyrus was taken are all dropped!
