Idaho Supreme Court Issues Order Setting Briefing Schedule And Oral Argument In Challenge To Medicaid Expansion/Proposition 2

Boise, ID—On Monday, December 3, 2018, the Idaho Supreme Court entered an order regarding Briefing and Hearing. The Court ordered that briefing by Respondent, Lawerence Denney, is ordered to be filed 21 days from the date of December 3, 2018 but not later than December 24, 2018 at 12:00 p.m. MST. Further, the Court ordered that Brent Regan shall file any response by January 9, 2019 at 5:00 p.m. MST. Finally, the Court ordered that the matter is set for oral argument/hearing on January 29, 2019 at 9:00 a.m. MST.

Parties normally file legal actions in the lower courts. These cases can work their way up through the appellate process often taking months or years to resolve. The fact that the Idaho Supreme Court agreed to accept the case and issued an expedited briefing and hearing schedule indicates that the Idaho Supreme Court believes that the case presents a substantial question regarding the constitutionality of Proposition 2 that the Court wants to address as soon as possible.
