Is This Stupid Legislation?

“But the statute of king Charles II., which prescribes a thing seemingly as indifferent, (a dress for the dead, who are all ordered to be buried in woollen,) is a law consistent with public liberty; for it encourages the staple trade, on which in great measure depends the universal good of the nation.” – William Blackstone “Commentaries on the Laws of England”

Seriously, Blackstone? Legislating people be buried in wool clothes or blankets is a good thing because it creates a demand for wool? Thereby stimulating the staple trade of people raising and sheering sheep, manufacturing the clothes or blankets, and merchants selling them. Blackstone continues:

“So that laws, when prudently framed, are by no means subversive, but rather introductive, of liberty; for, as Mr. Locke has well observed, where there is no law there is no freedom. But then, on the other hand, that constitution or frame of government, that system of laws, is alone calculated to maintain civil liberty, which leaves the subject entire master of his own conduct, except in those points wherein the public good requires some direction or restraint.”

The ideas of liberty and freedom demand that the public not be directed as if they were employees of a corporation. Especially directed in something as mindless as having the end product buried in a grave. How many graves from hundreds of years ago in England still have people buried in wool?

Does this mindset exist in our modern world?

Ken Rogoff: …But I also question how much just untargeted stimulus would really work. Infrastructure spending, if well spent, that’s great. I’m all for that. I’d borrow for that, assuming we’re not paying Boston Big Dig kind of prices for the infrastructure.

Fareed Zakaria: But, even if you were, wouldn’t John Maynard Keynes say that if you could employ people to dig a ditch and then fill it up again, that’s fine. They’re being productively employed, they pay taxes, so maybe the Boston’s Big Dig was just fine after all?

This insane mindset even exists at the highest levels:

What dismay rises over seeing people accept such mindlessness? Automation is an awesome labor saving capability in our modern world; to not use automation is…well, let us hear what a prisoner of the Soviet Gulag digging the Belomor Canal circa 1932 had to say:

“The country required the canal so urgently and in such haste that it could not even find any wheelbarrow wheels for the project! It would have been too difficult an order for Leningrad factories. Isn’t it insane when recognition can be attributed by saying, “At least they dug the canal and did not then fill it back in again.”

There is also a very important fact about the Soviet Gulags that should be recognized; the Gulags were not filled with enemies of the state or political dissidents; they were in large part filled with believing Communists. So how did they end up in the Gulags? Because the Gulags were “Work Camps”; they needed people to cut the trees and mine minerals; that is why there were quotas for the police to fill whereupon they would go out and randomly arrest anyone and send them to work in the Gulag.

Putting an acerbic exclamation point to Communist Plank #8: “Equal obligation of all to work…”

What liabilities are there in the USA for being forced to work? The Naturalization Oath says: “…; that I will perform work of national importance under civilian direction when required by the law;…” And there are stacks of laws and Executive Orders where one small clause could be interpreted as giving the Government the power to make people work. Let alone how the citizens are currently being “directed” in mindless ends.

Being a free people, what are we to think when news articles like this one are presented?

“Senator Bernie Sanders is looking ahead to the 2020 presidential election with a proposed federal government program that guarantees all Americans a job with health insurance. Nearly half of voters like the idea.

The survey of 1,000 Likely U.S. Voters was conducted on April 24-25, 2018 by Rasmussen Reports. The margin of sampling error is +/- 3 percentage points with a 95% level of confidence.”

How many of these jobs will be mindless jobs resulting in no real value? And the multitudes having these government jobs will swear holy allegiance to the Federal Government to keep these jobs.

Artificially creating a demand through legislation or engaging in work whose only value is to give people something to do is so very mindless…worse, it is Statist.
