  1. 09:08 Mr. Snyder stated that “there can never be any compromising on the Second Amendment, not even a single inch!

10:46 Mr. Snyder stated that” When it comes to the Second Amendment, I will never compromise!”

Mr. Snyder, does this mean that you are you pledging to your campaign for the revitalization of the Militia of the several States that was destroyed by an agreement between the Congress and the States at the turn of the 20th century? After all, the first clause of the Second Amendment still states that “A well regulated Militia, being necessary to the security of a free Stats…” as envisioned, legislated, and enshrined by our Founders.

Mr. Snyder, where do you stand on the first clause of the Second Amendment?

  2. I watched the interview, and I would like to ask the Captain who was interviewing a question:
You asked Michael about being in the Militia, and how by the Idaho Constitution, everyone was in the Militia. Did you mean everyone 18-45? Or everyone, everyone?

The first section of this constitution reads:

CONSTITUTION OF THE STATE OF IDAHO
    APPROVED JULY 3, 1890
    ARTICLE XIV
    MILITIA

SECTION 1. PERSONS SUBJECT TO MILITARY DUTY. All able-bodied male persons, residents of this state, between the ages of eighteen and forty-five years, shall be enrolled in the militia, and perform such military duty as may be required by law; but no person having conscientious scruples against bearing arms, shall be compelled to perform such duty in time of peace. Every person claiming such exemption from service, shall, in lieu thereof, pay into the school fund of the county of which he may be a resident, an equivalent in money, the amount and manner of payment to be fixed by law.

Arizona recently passed legislation that removed the upper age limit, but, to my knowledge, we didn’t.

Also, if we are using the Idaho Constitution to back up a valid Militia, wouldn’t there only be one? After a quick search, I can find at least two -The Idaho Lightfoot and the North Idaho. So which is legitimate? Also, again going back to the Idaho Constitution, Sections 2 and 3 appear interesting. Of the two militias I found, have the officers been appointed by the Governor?

I am all for a militia – but, you kept going back to the Idaho Constitution. Is there a legitimate one here that is recognized as such?

    Thank you!

    • Ron,

If you don’t mind me speaking up, and not to take anything away from the Captain:

At the turn of the 20th century the first clause of the Second Amendment was destroyed by an agreement between Congress and the several States by way of the Militia Act of 1903 and the National Defense Act of 1916. They essentially tossed the Militia of the several States (as envisioned, legislated, and enshrined by the Founders) out and replaced it with the National Guard, as well as unorganized and organized militias. [Refer to the Idaho Statues Title 46 for details.] Why would Congress and the several States do this? Primarily to remove most people from active participation in any form of Militia organization.

The Idaho Constitution ARTICLE XIV MILITIA and the Idaho Statues Title 46 are based on the National Defense Act of 1916, the same Act that destroyed the original Militia of the several States, first clause of Second Amendment.

You asked, “Also, if we are using the Idaho Constitution to back up a valid Militia, wouldn’t there only be one?” Yes, as you say there is only one militia of Idaho. It states in the Idaho Statues Title 46 that the militia of the state of Idaho is divided into three (3) classed, to wit:

      1. The national guard (means the Idaho army national guard and the Idaho air national guard).

      2. The organized militia (means any portion of the unorganized militia called into service by the governor, and not federally recognized).

      3. The unorganized militia (includes all of the militia of the state of Idaho not included in the national guard or the organized militia).

You then asked, “After a quick search, I can find at least two -The Idaho Lightfoot and the North Idaho. So which is legitimate?” All of the militias you referred to (Idaho Light Foot, North Idaho, and some others like the Idaho III%) and others fall into the third class as unorganized militias, according to Title 46 and are “legitimate” under the Idaho Constitution.

However, this is where it gets interesting, to say the least! Being in the unorganized militia class, means that the state of Idaho has left millions of able-bodied members out there on their own, without any organization, arms, discipline, training, or governance which, by the way, under the original Second Amendment they were supposed to provide in the event that Congress was unable or unwilling to do so. Said another way, the unorganized militia in Idaho is, for the most part, unorganized, unarmed, undisciplined, and ungoverned…EXCEPT FOR WHAT THEY ARE ABLE TO DO ON THEIR OWN AT THEIR OWN EXPENSE, WITHOUT ANY STATE ASSISTANCE OF ANY KIND!!! The unorganized militia is NOT supported in any way, shape, or form by the state of Idaho.

However, according to Idaho Statues Title 46, the unorganized militia can be called up by the Idaho governor in the event that there is some crisis, calamity, or real catastrophe that threatens the security of the free state of Idaho. If it is called up, and it is unclear how this would be done, the unorganized militia (at least on paper) becomes the organized militia! Keep in mind that the unorganized militia is unorganized, unarmed, undisciplined, untrained, and ungoverned by the state of Idaho up to this point! How the unorganized militia will suddenly be able to assist in any crisis that the governor calls them up for, just because it changes to the organized militia class, is unclear! Basically, the unorganized militia, on the whole, is unprepared for dealing with any crisis that it could potentially be called up for by the governor.

The National Guard is NOT a militia (as defined in the original first clause of the Second Amendment) because it does not have the characteristics of a Constitutional Militia, being that it is not a near-universal compulsory membership organization. The National Guard is an adjunct of the regular Army, and as such can be deployed abroad with the standing army on military adventures of all kinds…something a true Militia of the several States could not.

Also, keep in mind that from a national Constitutional perspective, the unorganized militia is not abconstitutional “Militia” at all – as envisioned, legislated, and enshrined in the first clause of the Second Amendment.

The only way that our Militia of the several States can be revitalized back to what our Founders intended in our Second Amendment, is by legislative state statute. Unfortunately, the vast majority of Americans do not even know, or perhaps even care, that over 115 years ago their Militia of the several States was taken from them by rogue politicians at the federal and state levels!

  3. CORRECTION to MARCH 23, 2018 AT 2:52 PM, second paragraph: Remove reference to the Idaho Constitution ARTICLE XIV MILITIA and replace only with “The Idaho Statues Title 46, pertaining to the militia of the state of Idaho, is based on the National Defense Act of 1916, the same Act that destroyed the first clause of the Second Amendment, that being the original Militia of the several States.”

  4. Ron, you are very welcome!

Another point that I forgot to mention is that those members of the unorganized militia of Idaho who choose to form an organization that they call a ‘militia,” (such as the Light Foot Militia, the Idaho III%, et al.) which are technically unorganized militia, do so at their own time and expense, and are not reimbursed financially in any way by the state of Idaho. They also do not have any powers or authority beyond that of a citizen unless they are called into service by the governor.

  5. I just retired from the Alaska State Defense Force, a State recognized organized militia that answered to the Governor, not the President. I served 10 years active duty, and several years National Guard. I finished my 51 years, one month, and 23 days of service rising from enlisted, to CWO2, and retired as a Commissioned Officer, my commission granted by the Governor of Alaska. I served my last deployment in Puerto Rico for hurricane Maria aid and rescue. I was the Officer in Charge of not only my Defense Force military unit, but National Guard both Army and Air Guard members as well. This is how it should be.
The unorganized militia of Alaska is all able bodied citizens age 17 to 45 should the Governor call it into service. This happened twice once in WWII, and the 1964 earthquake. My deployment was the first ever such duty where we deployed out of state to the aid of another. We cannot be ordered to duty by the President unless Congress formally declares war.
In the event the Governor calls up the unorganized militia, it is the duty of the Alaska State Defense Force to train the called up units for deployment.

    STRUCTURE
The primary goal of the U.S. Militia is to form the nucleus of a strong civilian defense organization. Furthermore, it is to maintain a constant state of readiness in the event that it should be called up to perform its Constitutional functions.
Officers must effectively organize group efforts and provide for training, unit organization, response strategies, intelligence, security and communications. Logistics Officers must ensure the acquisition of resources consistent with the tactical role assumed by the unit. Every member must acquire and develop proficiency in the use of firearms, field and specialized equipment. Each member must be committed to the purpose and goals of the unit. In any organization, there needs to be a clear chain of command to insure effective
coordination of the smaller units. At the same time, units must be capable of responding to the immediate circumstances without having to request permission to act.
    TRAINING
All team members must pass Level 1 line qualifications. They must also train and cross-train in five basic skills.
The primary skills being: Operations, Engineering, Marksmanship, Medical and Communications. At full strength a team should have two persons in each assignment. Each team member will train in two assignments; a primary skill, and a secondary skill in case the primary man is unavailable.Training is a vital part of our operations. and occurs continuously.
All training is conducted with safety in mind. We are always exploring new types of training. We leverage the skills of our Militia and strive to give the most expert training for our Battalions. Some of the skills we specialize in include:
    • Land Navigation (Map and Compass)
    • Tactical Systems
    • Radio Communication / Hand Signals
    • Ranging and Ballistics First Aid / CPR Disaster Relief
    • Firearm Safety
    • Marksmanship
    • CQB (Close Quarters Battle)
    • Self Defense
    • Survival
    • CBRN Preparedness (Chemical, Biological, Radiological, Nuclear)
    • Civil Unrest
    • Search and Rescue
    • Family Preparedness
    …and many others!
Training generally occurs on weekends, however other training will be made available for those who can not attend weekend trainings. Take note not all training takes place in the field. Certain classes such as medical and CPR are classroom trained. We simply ask that you attend as many as you can, when you can. We are only as good as our proficiency in our trained skills.
WE ARE NOT / WE DO NOT
    • Promoting the overthrow of any government whether local, state or national.
    • We want our governments to return to the Constitutional Republic which the Declaration of Independence and the Constitution defined and instituted.
    • We are not advocating or promoting violence towards any organization, group or person.
•We are not advocating or promoting the removal of any person from his or her elected office unless they are violating the Constitution.
YOU WHO ARE CONSIDERING JOINING THE U.S. MILITIA:
You may be saying, “what can I do?” or “I don’t have any training for that!” We understand. The militia is unlike anything you’ve probably ever experienced. It requires you to ask more of yourself, to learn new skills, and to take the path less traveled. It requires courage, integrity, and strength of character.
The U.S. Militia is dedicated to defending our fellow man, helping those in need, facing disaster and taking a stand when it is much easier to do nothing.
