Is the Bunkerville Trial of the Century Finished?

The Las Vegas trial of Cliven Bundy, and others, began this morning after a long break of over a week. However, only about an hour and half into the hearing saw Judge Gloria Navarro release the jury for the remainder of today and tomorrow, later extending the time. She made comments indicating the jury may not be coming back at all. “The jury won’t be called back before [December 20th], if they are needed,” Judge Navarro said.

What brought this on?

Judge Navarro discussed in open court the numerous violations made by the prosecution and the agents of the BLM and FBI in relation to this case.

Multiple Brady violations topped the list, with many exculpatory items not being turned over to the defense teams. Items such as the Threat Assessment reports, names of potential witnesses, reports from the Office of the Inspector General (OIG) reprimanding the BLM for not enforcing the court orders for years, and many more.

There are at least seven Brady violations the judge referred to in court today. Additionally, there were violations of evidence not being turned over in a timely manner, which are referred to as ‘Giglio’ violations, pointing to the court decisions of Giglio v. United States .

After the jury was sent home, the courtroom was cleared of spectators so the principle players could immediately go into another of the now infamous super-secret sealed hearings.

This court trial has become known for their overuse of the sealed hearing rules. A majority of the evidence has been sealed from the public view, bringing questions as to why the government is hiding so much information from the citizens. Our Constitution guarantees public trials, yet the government does not hold themselves accountable to the US Constitution, as their representative so testified.

They seem to only believe in transparency when it suits their agenda, and the Bundy Ranch Protest trial is quickly falling far from their agenda.

Before long, several defendants and defense attorneys exited the courthouse with news that the court is in recess until December 20th. The sealed hearings are over for the day and the prosecution has been given over a week to prepare their responses to the plethora of motions filed by the defense.

Many of these motions have been sealed, as they refer to bad acts by the government, and this judge continues to try to hide those facts from the public. She has made it her mission to not allow the government to look bad in front of the jury, and she hopes, in the public perception.

  1. Navaro is probably in fear of losing her job she has already lost her reputation along with the bunch of dishonest prosecutors who have the same fate waiting for them.

  2. Trump’s Utah rally / speech probably has them thinking their seats are only going to get hotter, as Trump is clearly not on their side. There is probably pressure to bow out gracefully.

    • Dave : Myhre and Co are definitely in the hot seat. He may be shopping for some tropical togs to wear at his next job assignment – the Marshall Islands.

  3. A mistrial? for prosecutorial misfeasance or malfeasance should result in sanctions! Ergo, a bench judgement of innocent, or no judgement, but case is done for time served. ( Called a “type” of verdict , I forgot the name of it – named after person it was first used on. It’s neither guilty or innocent, but double jeopardy attaches. The record is expunged after 24 months or something, as if it didn’t happen. Otherwise it’s a punching bag, and government gets to punish- no different than burning cattle, and there is no penalty.

    • Barry : In Navarro’s book, a mistrial occurs if or when no convictions are rendered. Her misuse of this mistrial dodge allows the Govt another shot. If you recall, the jury returns in the two previous trials were hung, with only three out of the twenty four jurors holding out for “Guilty”. It is ludicrus to suppose that,in this third trial, the govt could completely reverse this trend and secure a unanimous twelve guilty verdicts. Were our guys still in custody, The feds might be be hoping to extort plea deals,but no dice now. As we have seen in Ryan’s and Ammon’s press interviews, they are as determined as ever to fight through,and that grand old man is shaming the Govt from behind bars.

  4. Finished ? Hard to say, but the Govt is certainly in disarray. We spent the morning listening to a recitation from Navarro, categorically denoting the raft of motions submitted by the defense. As noted in Ms Dovale’s article, the gist was a mass of defalcations and “Omissions” committed by Myhre and company, effectively shooting their case full of holes. Creature of Harry Reid or no, Navarro may fear for her reputation.The crunch has come in this Bundy et al case, and the govt is on the edge of an abyss.You have to wonder how, after having three years to prepare, the prosecutors could find themselves struggling to keep their heads above water. One thing for sure: they have been out for the Bundy’s blood throughout this affair, and we have no sympathy for them. We Courthouse gang are nonplussed. Many of us, including yours truly, came bucu miles,and for what ? If, after another hiatus a mistrial is declared, what then ? What kind of legitimate case could they mount ? It’s a gigantic Federal boondoggle folks.

  5. Thanks for this update! Yes, here is what the constitution says about public trials: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed,” Like the speedy trial, the public trial is a thing of the past. Why? Because the government keeps eroding these rights and the people, allow it to happen.
